Please use this form to accept the website proposal and (if appropriate) the associated design theme submitted to you by TOSD.

Terms and Conditions

  • If a graphical design has been submitted as part of this proposal then up to two hours of modifications are available at no additional charge. The Standard Rate ($80.00/hr) will apply for all design work in excess of that allowance.
  • In transferring a graphical design, which is a drawing, to a fully rendered website displayed on a monitor, small changes to the resultant appearance may occur. Equally, there may be differences in the way a user’s browser renders particular features. TOSD will make every effort to minimise these effects, but can make no guarantee that the completed web facilities will appear to be identical on every user’s monitor.
  • Where training or development meetings are required to be held on the client’s premises additional charges will apply.
  • If this proposal has provisions for content (text, images, video or tabulated data) to be uploaded and formatted by TOSD then it will be the client’s responsibility to check the accuracy of the resultant work. TOSD will accept no responsibility for any errors or omissions that may inadvertently occur. If notified within 14 days of the completion of work however, corrections will be made at no charge.
  • Clients are required to ensure that the content of their website meets all current Australian legislation regarding publications. The client shall further indemnify TOSD in respect of any claims, costs and expenses that may arise from any material included in their site by TOSD at the client’s request.
  • This proposal is for the design and deployment of a web site and/or associated facilities. Unless otherwise specifically stated it does not include Internet marketing services or copywriting. Should those services be required please contact TOSD.
  • Warranty Support is available for a period of 90 days from the completion of work via the TOSD Support Desk . This provides clients with written help and advice on any matter associated with their website.  In addition, any aspect of the website that is found to be not functioning correctly, or not in accordance with this proposal, will be corrected during the Warranty Period at no charge.
  • After completion of the Warranty Suppport Period ongoing written help and advice will still be available to all clients via the Support Desk. If actual work needs to be performed on a client website however, such work will be chargeable at the Standard Rate. The cost of this ongoing support is covered by the hosting fees.
  • Support advice on other associated matters including (but not limited to) image preparation, PC based email setup and general computer skills will only be available via the TOSD web site or Support Desk Knowledgebase.
  • Hosting is provided to clients with the following undertakings and conditions:
1. Scheduled offsite backups will be executed by TOSD on a weekly basis. The cost of this service is covered by the hosting fees, so no further charge is applicable.
2. Offsite backups of a hosting account include all application system files, data files, images and associated databases. They do not include emails. It is the client’s responsibility to back up their emails.
3. In the event that a hosting account has to be restored, work will be charged at the Standard Rate.
4. While all due care (including offsite backups) will be taken by The Online Shop Designer (TOSD) to protect the client’s online assets, The Online Shop Designer (TOSD) will accept no responsibility, or be held liable in any way, for loss as a result of unauthorised breaches of security  (‘hacking’), client error or equipment failure.
  • In the event that The Online Shop Designer (TOSD) has to engage the services of a debt collection agency to recover monies owing, the cost of such services will be added to the amount owing and will be payable by the client.
